PROCLAMATIONS

The Council issued proclamations recognizing Gilberto Garza Jr., superintendent, Edinburg Consolidated Independent School District, and Mayor Joe Ochoa.

PUBLIC HEARINGS/ORDINANCES/VARIANCE

• Approved ordinance providing for the comprehensive plan amendment from General Commercial Uses to Auto-Urban Uses and the rezoning from Commercial, General (CG) District to Auto-Urban (AU) Residential District, being 15.64 acres out of Lot 57, Kelly-Pharr Subdivision, located approximately 300 feet west of Sugar Road on the south side of Alberta Road, as requested by Edinburg CISD.

• Approved ordinance providing for the comprehensive plan amendment from Industrial Uses to Agriculture Uses and the rezoning request from Commercial, General (CG) District and Industrial (I) District to Agricultural (AG) District, being 15.73 acres out of Lot 1, Section 244, Texas-Mexican Railway Company Survey, located approximately 660 feet west of Roegiers Road on the south side of Monte Cristo Road, as requested by Antonio Villarreal.

• Approved ordinances providing for the comprehensive plan amendment from Auto-Urban Uses to Suburban Uses and the rezoning request from Agricultural (AG) District to Suburban Residential (S) District, Lots 9, 10, 33 and 34, Americana Subdivision, located approximately 1,300 feet west of Jasman Road on the south side of Flagg Drive, as requested by the City of Edinburg.

• Approved ordinances providing for the comprehensive plan amendment from Urban University Uses to Neighborhood Commercial Uses and the rezoning request from Urban Residential (UR) District to Commercial Neighborhood (CN) District, being the north 62 feet of Lots 7-9, Block 186, Edinburg Original Townsite, located at 315 N. 10th Ave., as requested by Arnulfo Martinez.

• Approved ordinance providing for the rezoning request from Agricultural (AG) District to Commercial, General (CG) District, being 1.675 acres out of Lot 6, Section 276, Texas-Mexican Railway Company Survey, located approximately 1,000 feet north of State Highway 108 on the west side of McColl Road, as requested by Roy Strawser.

• Approved ordinance providing for the rezoning request from Neighborhood Conservation 7.1 (NC7.1) District to Commercial, General (CG) District, Lots 7-12, Block 279, Edinburg Original Townsite, between 14th Ave. and 15th Ave. on the north side of Mahl Street, as requested by the City of Edinburg.

• Approved ordinance providing for a special use permit for an On-Premise Consumption of Alcoholic Beverages for Dubai Bar and Grill, Lot 4, Jackson Corner Subdivision, located at 2220 W. Trenton Road, as requested by Mario Gonzalez.

• Approved ordinance providing for a special use permit for an On-Premise Consumption of Alcoholic Beverages for Velocity, Lot 1, Trenton Crossroads Plaza Subdivision, located at 2005 W. Trenton Road, as requested by Max R. DeLeon and Cassandra N. Rodriguez. At the request of Council member Alma Garza, the permit was granted for 18 months instead of the usual 12 months.

• Approved ordinance providing for a special use permit for an On-Premise Consumption of Alcoholic Beverages for J.B’s, Lot 1, Trenton Crossroads Plaza Subdivision, located at 2145 W. Trenton Road, as requested by Tina Alexander. The council also granted this permit for 18 months.

• Approved a variance to the City of Edinburg Thoroughfare Plan for Additional Road Right-of-Way along McColl Road (FM 2061) for McColl Road Subdivision, as requested by AEP Texas.

APPOINTMENTS

• Appointed Fernando Garza to the Edinburg Golf Board.

• Appointed Desiree Mendez to the Edinburg Public Library Board.

BIDS/CONTRACTURALS

• Awarded Bid No. 2009-46, Sugar Road Paving and Drainage Improvements, to IOC Company LLC, in the amount of $2,198,888.98.

• Authorized the purchase of three digital video cameras for marked police cars from Coban Research & Technologies Inc. from Stafford, Texas, in the amount of $18,825.

• Authorized the City Manager to enter into a contract agreement between the City of Edinburg and Raba-Kistner Consultants Inc. for materials testing and engineering, and environmental services for the Sugar Road Paving and Drainage Improvements Project, in the amount of $21,600,21.

• Authorized the City Manager to enter into an Interlocal Cooperation Agreement between the Edinburg CISD and the City of Edinburg for improvements to the South Middle School parking area and the 4th Street and Freddy Gonzalez Drive intersection.

CONSENT AGENDA

• Approved a resolution authorizing intervention in AEP Texas Central Company’s and AEP Texas North Company’s request for approval of an Advanced Metering System (AMS) Deployment Plan and request for AMS Surcharges filed at the Public Utility Commission of Texas; approved cooperation with the Steering Committee of Cities Served by AEP Texas Central Company and Steering Committee of Cities Served by Texas North Company to review the application, hire legal and consulting services and to negotiate with the company and direct any necessary litigation and appeals; finding that the meeting at which this resolution is passed is open to the public as required by law; requiring notice of this resolution to legal counsel.

• Authorized disposition of approximately 45 cubic feet (boxes of letter size records) of non-vital city records in accordance with the Texas State Library and Archives Commission Local Records Retention Schedules.

• Transferred $12,000 in the Public Works/Streets city budget from the Capital Outlay Account to the Traffic Control Account.
